The ongoing debate surrounding the European Union’s (EU) Artificial Intelligence (AI) Act has intensified, particularly following Italian economist Mario Draghi’s recent call for a pause in the legislation’s implementation. Draghi raises important concerns regarding the pace at which the EU is moving, suggesting that regulatory frameworks are being instituted without fully understanding the potential drawbacks. However, while the impetus for a pause may arise from a place of caution, it does not address the fundamental issues embedded within the AI Act itself.

The fundamental premise of the AI Act is to serve as a “future-proof” regulation, purportedly designed to accommodate emerging technologies. Yet, this claim is misleading. The Act offers a broad definition of AI, reflecting an assumption that its scope can encapsulate the future developments in the field. However, those familiar with machine learning and AI know that the field is marked by rapid evolution and unpredictability. A definition that appears comprehensive today may become obsolete in a matter of years, thereby rendering the regulations irrelevant.

The introduction of a risk-based logic in the AI Act, which categorizes obligations based on the sector in which AI is deployed, seems logical on the surface. However, this structure has already shown its limitations. With the advent of technologies like ChatGPT and other advanced language models, which operate across multiple sectors and applications, the regulatory approach has become more complicated and less effective. Policymakers were compelled to implement a capabilities-based regulatory layer to account for these general-purpose AI systems, underscoring a significant lesson: no matter how comprehensive a regulatory design may appear, technological advancements can easily undermine its architecture.

Another critical issue lies in the structural constraints associated with the AI Act. Currently, there is no stable system for continuous monitoring of the Act’s effects, leading revisions to rely primarily on annual reviews. Delegated acts allow for some technical adjustments from Brussels, but the crux of the matter is that the process remains slow and often subject to political influence. The European Commission functions as a gatekeeper, limiting the agility needed to implement necessary changes. Given that hundreds of technological innovations surface each month, no single authority can respond swiftly enough. Innovators operating within the EU may find themselves in a stasis, awaiting guidance that arrives too late, long after technologies have already evolved.

The implications of a sluggish and rigid regulatory framework are significant. Current trends show that European firms are lagging behind their American and Chinese counterparts in the development and deployment of AI technologies. A slow and unresponsive regulatory regime may only exacerbate this disparity. Rather than establishing a competitive advantage based on trustworthy AI, the EU risks creating a trust gap—leading to a region less conducive to innovation and competition.

Nevertheless, there is an opportunity for the EU to enact a more sustainable and responsive regulatory structure that promotes adaptability. Rather than imposing a temporary pause on the AI Act, lawmakers should focus on embedding adaptability into the legislation itself. This could involve creating mechanisms for continuous data collection on outcomes and requiring machine-readable data reporting. Establishing clear thresholds, such as specific metrics for compliance costs or incident reporting with small companies, could also inform necessary revisions to the Act.

Implementing these adaptive mechanisms would enable the AI Act to monitor and respond to its own effects, allowing for iterative learning and continuous improvement. In this manner, the legislation could shift from being a static regulatory framework to functioning more like a GPS—constantly recalibrating in response to changing conditions while maintaining its long-term objectives.

Draghi’s apprehensions about the rapid pace of regulation are valid. However, the core reality remains that there is no such thing as a “future-proof” AI Act. The dynamic nature of technological advancement means that regulations must inevitably evolve alongside it. The critical decision facing policymakers is not so much whether to proceed quickly or slowly, but whether to adopt a rigid framework or develop one that is adaptable to innovation and emergent challenges.

In summary, the European Union must navigate the complexities of AI regulation with an eye toward the long-term consequences of rigidity versus adaptability. A future-responsive legislative framework will not only safeguard public interests but also position the EU as a viable leader in global AI innovation. Failing to adapt could lead to continued technological evolution outside of the EU, ultimately hindering Europe’s standing on the global stage. The choices are clear: either evolve with technology or find oneself increasingly obsolete in a rapidly advancing world.
